provides entertainment for performances in the UK and Internationally.
These terms and conditions constitute our agreement with you for the
hire of artists featured in the Entertainments Ltd portfolio. These
are referred to as our 'terms'.
Your booking with Entertainments Ltd is conditional on you accepting
our terms. If you do not agree with any part of them, you must not
proceed with your booking. By signing Entertainments Ltd booking forms
or contracts or completing our online confirmation form you accept
that you have read, understood and accepted our terms. If there is
any part that you do not fully understand, or if you have a query
about your booking, please contact us
DEFINITIONS
Artist means any performer required for entertainment.
Electronic means any information received or sent by email.
Force Majeure means unusual and unforeseeable circumstances beyond
our control, resulting in events that we could not have avoided even
if we had taken every possible care. Such circumstances include (but
are not limited to) war or threat of war, riot, civil strife, industrial
dispute, unavoidable technical problems with transport, closure or
congestion of airports, terrorist activity, natural or nuclear disaster,
fire and adverse weather conditions.
A tailored quote will include all other charges as notified to Entertainments
Ltd.
PRICES
The prices are accurate at the date of publication of this website.
Prices are intended as a guide for performances based on a typical
arrival allowing the artist sufficient time to set up their equipment
and perform all necessary checks to ensure a safe environment and
a quality performance. All prices are a reflection of performers’
fees for standard dates. Additional fees may be required for peak
seasonal performances and do not include ‘other charges’
– see below. You should consult us to obtain the latest prices
for performances to suit your event. A guide to artists travel fees
is advertised as an approximation for performances in that location.
Comprehensive quotes will be provided on request that include all
other charges.
OTHER CHARGES
Other charges include early arrival or set up times, extended performances,
performances outside typical hours, increased number of performers,
additional equipment such as PA, lighting or effects in addition to
that already provided by the artist, overnight accommodation, flights
and transfers.
BOOKINGS
Entertainments Ltd acts as an agent to all the artists featured within
its portfolio, does not employ them directly for any bookings, and
is not responsible for any loss, damage or injury incurred during
any performance. All performance contracts are between the client
and the band where:
ARTISTS ARE RESPONSIBLE FOR:
· Advising of any changes to their act which differs from that
advertised on the Entertainments Ltd web site
· Advising Entertainments Ltd and the client when any deputy
personnel will be used for performances due to illness or force majeure
· Providing a performance similar to that as advertised by
Entertainments Ltd on our web site and promotional material
· Arriving, setting up and performing as per times outlined
overleaf or, subsequently, negotiated with the client
· Providing all instruments, microphones, cables, PA, lighting
or any other equipment deemed necessary for each performance except
where a client has already arranged for equipment to be made available
· Ensuring the safety of all equipment used whilst on site
and secure the safety of any persons in proximity of the equipment
supplied
· Performing in a polite and professional manner whilst at
any engagement and not to damage the reputation of any party involved
· Providing their own public liability insurance for each performance
to the minimum value of £1 million
· Leaving the facilities as found on completion of the engagement
· Paying their own taxes, national insurance and VAT following
each engagement
CLIENTS ARE RESPONSIBLE FOR:
· Providing full details of the required performance including
timings, venue details, contacts and special requirements
· Providing or paying for adequate parking facilities for the
artist’(s) vehicles
· Providing an appropriate and safe environment to perform
in, which will include a covered performance area on a dry, flat surface
under cover and with good access to loading/unloading facilities.
Typically, a band will require a 4m x 3m performance area. This may
vary depending on the number of performers
· Ensuring performers have access to suitable and secure changing
facilities
· Ensuring adequate power supplies are available where appropriate.
Typically, a band will require a minimum of 2 x 32 amp sockets. Extension
leads, cables and other equipment will be supplied
· Advising of any sound restrictions at the venue or any other
restrictions which may affect an artists’ access or performance
· Providing soft drinks, a hot meal or buffet for each artist
CONFIRMATION
One signed copy of this form must be returned within 7 days and, on
receipt, Entertainments Ltd will secure the entertainment for your
event and provide contracts to the artist(s) to secure their engagement.
You should keep one copy for your records. The information overleaf
forms the basis of artist contracts and it is important that information
is accurate to ensure a successful performance. A representative will
contact you 4 weeks prior to the performance date to ensure all information
is current.
PAYMENT
All bookings must be secured by a signed booking form and a deposit
as advised at the time of your booking.
Balances will be due to either Entertainments Ltd or the artist 21
days prior to the performance date. VAT will be charged @ 15% on any
balance where Entertainments Ltd accepts monies on behalf of the artist.
The artist will not accept cheques as balance of payment on the date
of the event without prior consent. Cheques for balances must be made
payable to the artist unless otherwise arranged. A representative
will contact you 4 weeks prior to your event to advise on balance
payments.
CHANGES TO YOUR BOOKING
IF YOU MAKE CHANGES
For advice on amending a booking, please contact us.
It may be possible for extended performance times to be negotiated
directly with the artist on the performance date.
Any major changes to the original booking will incur a £25 administration
fee and any appropriate charges on behalf of the artist such as extended
performance times, additional performers etc.
IF THE ARTIST MAKES CHANGES
Where an artist (or member of an act) is unable to attend a performance
due to illness or ‘force majeure’, a deputy or alternative
will be provided of similar quality and experience to that performer.
Any deputy provided should not affect the quality of any entertainment.
All artists agree to advise Entertainments Ltd should their act change
from that advertised by Entertainments Ltd.
CANCELLATIONS
To cancel a booking, the client must send Entertainments Ltd a signed
cancellation instruction in writing. This instruction must be sent
to Entertainments Ltd at the address on your booking confirmation.
Cancellation takes effect on the date we receive your letter.
The outstanding balance/full performance fee will be due to the artist
for cancellations made within 90 days of the performance date. Cancellations
outside of 90 days of the performance date will result in the loss
of any deposit paid.
All cancellations will incur a £25 administration fee. Outstanding
payments from bookings and cancellations will be referred to our legal
department if not received within 28 days of the due date.
IF THE ARTIST CANCELS
When the artist agrees to the performance either verbally, by email
or in writing, the artist will be unable to cancel the booking for
any reason other than those highlighted by ‘Force Majeure’.
All artists must notify Entertainments Ltd immediately where a performance
cannot be fulfilled as indicated in their contract. Failure to do
so may result in action being taken by the client against the artist
for non-fulfilment of their contract. Any artist cancelling their
performance will be liable to additional fees where an alternative
artists’ fee supplied by Entertainments Ltd exceeds the original
artists’ fee. In addition, a £25 administration fee will
also be incurred. Any action taken by the client for non-fulfilment
of booking is between the client and the artist. In addition, action
taken by any client will not prejudice the right of Entertainments
Ltd taking action against the performers for damages or loss incurred
by Entertainments Ltd.
Where Entertainments Ltd is aware that an artist is unable to attend,
we will take all reasonable steps to find a suitable replacement for
the performance. If unable to do so, a full refund will be given.
POSTPONEMENTS
If, due to Force Majeure, your event needs to be rescheduled, bookings
must be rearranged for a performance within 12 months of the originally
booked performance. Where an artist is not available to perform on
a re-aranged date, a postponement will be treated as a cancellation.
RE-ENGAGEMENT
The client and artist agree that subsequent bookings within a 12 month
period, from any artist provided by Entertainments Ltd will be booked
directly with Entertainments Ltd and not with the artist directly.
DATA PROTECTION POLICY
Entertainments Ltd operates and is registered in accordance with applicable
data protection legislation in the UK. To ensure that your performance
runs smoothly, we need to use information such as your name and address,
contact details as provided to Entertainments Ltd. We will apply appropriate
security measures to protect this data. However, we must pass it on
to artists. If we cannot pass this information to the relevant suppliers,
we cannot provide your booking. When you make this booking, you consent
to this information being passed to the relevant people. We can supply
a copy of your information held by us; there is a small charge for
providing this.
DISTANCE SELLING REGULATIONS
Entertainments Ltd abides by all current UK distance selling regulations
enforced in 2000.
